CHILD SUPPORT

    Whether the parents of a minor child (under 18) are divorced or were never married, Illinois law requires that both parents contribute to the financial well-being of the minor child.  This is accomplished through child support payments.  In Illinois, the parent who does not have residential custody of the minor child is required to pay child support to the parent with residential custody of the minor child.  Illinois has set specific guidelines that helps attorneys and judges determine child support amounts.  Illinois courts will rarely deviate from these guidelines unless there is a very good reason why they should.  The following are the Illinois child support guidelines:

- One child: 20% of net income.
- Two children: 28% of net income.
- Three children: 32% of net income.
- Four children: 40% of net income.
- Five children: 45% of net income.
- Six children: 50% of net income.

    In addition to the amount of child support set by these guidelines, the non-residential parent may also be ordered to help pay for reasonable expenses such as day care costs, extracurricular activities, life insurance for the child(ren) and extraordinary medical costs that are not covered by insurance.

    Although a certain amount of child support will be determined by the court, this amount is subject to modification in the future.  The most frequent reason for this is either an increase or a decrease in the non-residential parent's income.  If the income increases, then the child is entitled to an increase in child support and vice versa, if the parent's income decreases, the parent might be entitled to a decrease in child support.
