The issue of custody can sometimes be a bit confusing in Illinois. In Illinois there are two types of custody: Legal custody and residential custody. Under the heading of Legal custody, it is further broken down to joint custody or sole custody. The various types are explained below.
I. Legal Custody:
a. Joint Custody
Joint custody is awarded to both parents if they are deemed fit and able to make major decisions in the child's life. These major decisions may include education, religion, healthcare, etc.
b. Sole Custody
Sole custody may be awarded to a parent for various reasons such as the other parent not being fit to make or help in making major decisions for the minor child. When a parent is given sole custody, he or she will be the one making the major decisions in the minor child's life. The other parent can still make suggestions or take legal action if he or she believes that a certain decision is not in the best interest of the minor child.
II. Residential Custody:
Typically, one parent receives residential custody of the child with visitation rights for the other parent.
