Spousal Support, or sometimes called alimony or spousal maintenance, is the money that one spouse gives to the lower income spouse during the pendency of the divorce and/or after the divorce is finalized. In Illinois, there are three main types of spousal maintenance or support: temporary maintenance (which is paid during the pendency of the divorce), rehabilitative support (which is meant to last until the other spouse can become self-sufficient) and permanent maintenance or support (which is paid until the receiving party either dies or remarries.
Not all divorces require one spouse to give the other any support and unlike child support, there is no strict formula to calculate spousal support. Some factors that courts and Judges take into consideration when deciding whether to award any spousal support include, but are not limited to:
- Length of the Marriage.
- Income and property of each party.
- The needs of each party.
- Current and future income earning potential of each party.
- Standard of living during the marriage.
- The ability of the spouse seeking support to become employed.
- The age and health of the parties.
- Any agreements (pre or post- nuptials) the parties may have.
Spousal support ends when the party receiving the support either dies or remarries or the spouse paying dies or becomes disabled.
